Privacy Policy on the protection of natural persons regarding the collection and processing of personal data (hereafter the “Policy)

Introduction Trunscend TrRunscend is an application of informed coaching to support runners in achieving their performance objectives (hereafter the “application” or “app”). Originally, the app’s core feature is the generation of user-specific, short to mid-term detailed running plans, addressed to both recreational and aspiring athletes, whether preparing for marathons or following a structured workout routine. To this end, the app collects basic biometric data, such as age, weight, and running performance, to create personalized, effective training schedules. Governance and Incorporation Currently, TrRunscend is managed by a group of individual developers. In case of transition to an incorporated entity (“legal person”) to the purpose of scalable commercial exploitation, the Policy will be updated accordingly to reflect the assumption of the “Controller” and “Processor” roles by such entity, pursuant to GDPR Articles 4(7-8), 24, 26, 28 and 29 and Recitals (74), (79) and (81). When this policy mentions “Trunscend”, the “Company,” “we,” “us,” or “our,” it refers to the person responsible whether personally or under the capacity of a representative or agent acting on behalf of the namesake company under the distinctive title “Trunscend”, that is responsible for controlling and processing users’ personal information under this Policy. Future Application Updates In the future, the application may be enhanced with additional features to further customize user experience, such as medical history tracking, detailed biometric analysis, and community-based progress comparisons. These functions might require the collection of additional personal data, indicatively dietary preferences, health conditions, and thorough fitness metrics. The developers of TrRunscend shall update this Policy promptly and in accordance with the latest personal data legislation to ensure absolute compliance at any given time with any evolving legal or technological standards related to personal data protection. Policy Declaration This policy outlines the procedures for collecting, processing, and protecting personal data related to the app’s distribution and use (hereafter the “Policy”). Trunscend expressly commits to abide by the Regulatory Framework, as described under Chapter 2 of this Policy. This commitment extends to all aspects of the application’s distribution and use, ensuring lawful processing of personal data strictly as required by the app’s functionalities. Data collection is minimized to what is essential for operational or regulatory purposes, and robust measures are implemented to secure personal data by design and by default. Access to data is strictly limited to authorized individuals, safeguarding user information at every stage. These principles underpin our dedication to accountability, transparency, and regulatory compliance. Regulatory Framework This Policy aligns with the requirements of the legislative frameworks, as follow and in force (hereinafter jointly referred to as the “personal data legislation”): General Data Protection Regulation (GDPR) Regulation (EU) 2016/679, a set of comprehensive rules enforceable across the European Union (EU) and European Economic Area (EEA) for the natural persons’ fundamental right to the protection of their personal data pursuant to article 8(1) of the Charter of Fundamental Rights of the European Union and article 16(1) of the Treaty on the Functioning of the European Union (TFEU). GDPR’s importance lies in the introduction of new requirements regarding how people or entities identified as “Controllers” pursuant to the GDPR [Article 4(7)] should protect individuals' personal data that they collect and process. It also raises the stakes for compliance by increasing enforcement and imposing greater fines for breach. Greek Law 4624/2019, which transposed GDPR into Greek national law. TrRunscend is committed to complying with the lawful, fair, and secure processing of user data in conformity with applicable personal data legislation in all jurisdictions where the application is distributed or used, regardless of geographical boundaries, provided such compliance does not conflict with the mandatory principles (ius cogens) established under EU law. Notwithstanding the above, Trunscend, viewed as a “business” (in Greek «εκμετάλλευση») is set to be initially marketed within Greece, therefore collecting, processing and transferring of information of users located in Greece and/or the European Economic Area. Future international expansion will follow the prompt update of the Regulatory Framework accordingly. Definitions For the purposes of clarity and precision in this Policy, each of the terms referenced herein shall be strictly interpreted and defined as follows: Audit Trails: Unified electronic records that detail actions performed within the application, such as data access, modification, or deletion. Cookie: A small amount of data generated by a website and saved by a web browser to identify the browser, provide analytics, remember user information such as your language preference or login credentials. Country: Greece, where the Company or the owners/founders of Trunscend are based. Customer: The natural or legal person that signs up to use the Trunscend Service to manage the relationships with the app’s consumers or service users. Device: Any internet connected device such as a phone, tablet, computer or any other device that can be used to visit Trunscend and use the services. IP address: Every device connected to the Internet is assigned a number known as an Internet protocol (IP) address. These numbers are usually assigned to geographic blocks. An IP address can often be used to identify the location from which a device is connecting to the Internet. Personnel: Individuals who are or will be employed by Trunscend or are or will be under contract to perform a service on behalf of one of the parties. Personal Data: Any data that relates to an identifiable or identified individual. GDPR covers a broad spectrum of information that could be used on its own, or in combination with other pieces of information, to identify a natural person (in Greek “φυσικό πρόσωπο”). Beyond a person’s full name and email address, personal data may include financial information, political opinions, genetic or biometric data, IP or physical address, sexual orientation, and ethnicity. Service: The service provided by Trunscend as described in the relative terms of use (if available) and on this platform according to Chapter 1.1 of this Policy. Third-party service: Advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you. App/Application: Trunscend app, refers to the software product identified under Chapter 1 of this Policy. You: A person or entity that is registered with Trunscend to use the Service. What information do we collect? At this stage of the app’s development, data is collected solely by way of visiting the application and creating an account to use its service. Upon downloading the software, the user is required to create their unique login credentials (username and password) and provide Trunscend specifically with the following information: [● Name / Username ● Phone Number ● Email Addresses ● Mailing Addresses ● Billing Addresses ● Age ] As we work on developing the application features in view of contemporary user preferences and/or the addition of services, additional personal data might be collected by way of site registration, order placement, subscription to newsletters, responses to surveys or forms and so forth. The Policy shall be timely updated to reflect any new data collection channels and/or items respectively. When does Trunscend use End-user information from third parties? As we work to create hyperlinks to other software for advanced connectivity, we might require users to provide us on a voluntary basis with End User Data, including information they have made available to social media websites, necessary to access the Trunscend services. Users are encouraged to control how much of their information such websites make public by visiting them and changing their privacy settings. Do we share the information we collectcollection with third parties? During Trunscend’s business development, both personal and non-personal user information lawfully collected under this Policy may be shared with third parties such as advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest our users. We may also share it with our future affiliated companies and business partners. If we are involved in a merger, asset sale or other business reorganization process, we may also share or transfer such information to our successors-in-interest (in Greek «ειδικός διάδοχος»). We may engage trusted third-party service providers to perform functions and provide services to us, such as hosting and maintaining our servers and the app, database storage and management, e-mail management, storage marketing, credit card processing, customer service and fulfilling orders for products and services you may purchase through the app. We will likely share your personal information, and possibly some non-personal information, with these third parties on a need-to-know basis for them to perform their services as agreed upon for us and for our users. We may share portions of our log file data, including IP addresses, for analytics purposes with third parties such as web analytics partners, application developers, and ad networks. If your IP address is shared, it may be used to estimate general location and other technographics such as connection speed, whether you have visited the app in a shared location, and type of the device used to visit the app. They may aggregate information about our advertising and what is visible on the app and then provide auditing, research and reporting for us and our advertisers. We may also disclose personal and non-personal information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate in order to respond to claims, legal process (including subpoenas, interim measure requests and any other formal legal proceedings initiated by competent authorities). Such disclosure shall be carried out to the sole purpose of protecting our rights and interests or those of a third party affiliate and/or business partner, the safety of the public or any natural person, to prevent or stop any illegal, unethical, or legally actionable activity, or to otherwise comply with applicable court orders, laws, rules and regulations. Where and when is information collected from customers and end users? Trunscend will collect personal information that you submit to us. We may also receive personal information about you from third parties as described above. How do we use the information we collect? Any of the information we collect from you may be used in one of the following ways: To personalize user experience (your information helps us to better respond to your individual needs) To improve our app (we continually strive to improve our app offerings based on the information and feedback we receive from you) To improve customer service (your information helps us to more effectively respond to your customer service requests and support needs) To process transactions, when applicable To administer a contest, promotion, survey or other site feature To send periodic emails How do we use your e-mail address? By submitting your email address on this app, you agree to receive emails from us. As we work on developing our marketing plan, a newsletter shall be created in order to inform users on app or Company updates, encourage their participation in eventsto events relevant to the app’s services and subscribe to or examine promotional content. As soon as the newsletter goes live, users may choose to onboard it on a voluntary basis and shall be able to cancel their participation in any of our email lists by clicking on an opt-out link or other unsubscribe option that shall be included in the respective email. We will solely be sending emails to people who have authorized us to contact them, either directly, or through a third party. We shall not send unsolicited commercial emails, because we hate spam as much as you do. By submitting your email address, you also agree to allow us to use your email address for customer audience targeting on social media websites and platforms, where we shall be displaying custom advertising to specific people who have opted-in to receive communications from us. Email addresses submitted only through the order processing page will be used for the sole purpose of sending you information and updates pertaining to your order. If, however, you have provided the same email to us through another method, we may use it for any of the purposes stated in this Policy. Note: If at any time you would like to unsubscribe from receiving future emails, we shall include detailed unsubscribe instructions at the bottom of each email. How long do we retain your information? We keep your information only so long as we need it to provide Trunscend to you and fulfill the purposes described in this Policy. This is also the case for anyone that we share your information with and who carries out services on our behalf. When we no longer need to use your information and there is no need for us to keep it to comply with our legal or regulatory obligations, we’ll either remove it from our systems or depersonalize it so that we can't identify you. How do we protect your information? We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information. We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems and are required to keep the information confidential. After a transaction, your private information (credit cards, social security numbers, financials, etc.) is never kept on file. We cannot, however, ensure or warrant the absolute security of any information you transmit to Trunscend or guarantee that your information on the Service may not be accessed, disclosed, altered, or destroyed by a breach of any of our physical, technical, or managerial safeguards. Could my information be transferred to other countries? Trunscend shall be incorporated within the European Economic Area (EEA). Information collected through our app, direct interactions with you, or the use of our help services may be transferred to and hosted in locations outside the EEA. These locations may include countries that do not provide the same level of data protection as the EEA. Where such transfers occur, Trunscend ensures they comply with the Regulatory Framework under Chapter 2 of this Policy. Now therefore, any transfers of our users’ personal data to third countries shall (a) be made only to entities within countries deemed by the European Commission to provide an adequate level of data protection; (b) they shall observe the use of legally approved mechanisms, such as Standard Contractual Clauses (SCCs), Binding Corporate Rules (BCRs), or other lawful agreements, to protect your data; and (c) encryption, pseudonymization, or other technical and organizational measures to enhance data security. Users shall be informed by any appropriate means of any transfer of their data outside the EEA, including the safeguards in place. In some cases, explicit user consent may be requested for such transfers. By using our services, you acknowledge and agree that your personal data may be transferred and stored in locations outside the EEA as described above. Is the information collected through the Trunscend Service secure? Trunscend is determined to take all precautions necessary by way of physical, electronic, and managerial procedures to help safeguard personal data and prevent unauthorized access to the app. However, neither people nor security systems are foolproof, including encryption systems. In addition, people can commit intentional crimes, make mistakes or fail to follow policies. Therefore, while we make reasonable efforts to protect your personal information, we cannot guarantee its absolute security. If applicable law imposes any non-disclaimable duty to protect your personal information, you hereby agree that intentional misconduct will be the standards used to measure our compliance with that duty. Data Control and Management Procedures Trunscend is committed to comprehensive procedures for compliance with regulatory requirements and data security within the application environment. As our app evolves through the introduction of features requiring users to share special categories of data to enable more effective and personalized profiling, as well as to support the operational functionality of additional services, advanced data security procedures shall be adopted in line with progressive regulatory obligations and the scale of our operations. Indicatively, these may include but shall not limited to user guidance on personal data legislation to effectively exercise their rights, staff training initiatives including seminars and data breach simulations, regular audits and risk assessments to identify potential data protection hazards and introduce mitigation mechanisms, the appointment of a data protection officer (when applicable pursuant to the Regulatory Framework), data anonymization and psedonymization techniques etc. as follows: Regular Audits and Risk Assessments Trunscend conducts regular audits and risk assessments to ensure the effective protection of personal data. These may include but are not limited to: Data Protection Officer Appointment: Upon incorporation and to the extent deemed mandatory by personal data legislation in view of the scale of our operations, a DPO shall be appointed to oversee the implementation and evaluation of all measures pertaining to data protection. Inter alia, the DPO’s tasks shall include collaborating with certified external auditors to evaluate security systems and data processing methods. Results of such procedures shall be recorded in Audit Trails, which log every change to data or systems, ensuring transparency and traceability. For clarity, it is underscored that Trunscend is currently not bound by the Regulatory Framework to appoint a Data Protection Officer (DPO) and/or a Data Security Team . Compliance Audit Procedure: Periodic internal audits shall be conducted to ensure compliance with the Regulatory Framework. Data Protection Impact Assessments (DPIA): For every new feature or modification to existing processes, the DPO shall coordinate DPIAs, meant to analyze potential risks to users’ data and propose mitigation measures. Continuous System Monitoring: Trunscend aims to implement advanced risk-detection software such as Splunk, LogRhythm, and QRadar to analyze activities and detect anomalies in real-time, flagging suspicious behavior that may indicate security breaches. Data anonymization and psedonymization While we currently employ basic privacy safeguards, we are committed to enhancing our processes as resources and user data volume increase: Anonymization of Data: Transactional and activity data shall be encrypted to eliminate the possibility of user identification. Techniques such as differential privacy limit re-identification risks, and k-anonymity ensures that data cannot be uniquely attributed to a single user. Pseudonymization of Data: Data shall be replaced with unique identifiers (pseudonyms) linked only to corresponding decryption keys stored securely in Hardware Security Modules (HSMs). These keys shall be accessible exclusively to authorized personnel through multi-factor authentication (MFA). Data Breach Response Procedure Data breach response procedure Trunscend has an established protocol for the effective handling of data breaches: Incident Identification: Any suspected data breach shall be promptly investigated by external legal counsel. Notification of Authorities and Users: In compliance with Article 33 of the GDPR and Article 63 of Greek law 4624/2019, the independent Data Protection Authority under Greek law and affected users shall be notified of any breach within seventy-two (72) hours, unless it is reasonably determined that the breach is not likely to jeopardize the legitimate interests of the individual. Guidance for Users: Besides the distribution of the Policy, aAffected users shall receive clear information upon request (see Chapter 25) on how to protect their data and minimize risks. As our app grows, we intend to refine response mechanisms, namely by appointing a designated Incident Response Team led by the DPO to analyze and resolve data breach incidents; introducing a system for Security Incident and Event Management (SIEM); leveraging advanced technologies such as Splunk, IBM QRadar, and ArcSight to monitor application activities; implementing lean, predefined action plans to minimize the impact of breaches. Data Security Practices Basic data security practices currently in force include secure passwords and limited access to personal data, to protect against unauthorized access. As our app grows, we plan to implement advanced cryptographic methods and key management systems, namely including Hardware Security Modules (HSMs) and Access Audit Trails. Staff awareness and training Trunscend’s founding team is educated on GDPR principles and the importance of safeguarding personal data. We are developing protocols to simulate and respond to potential data breaches effectively. Those shall include, in due time, the following: Specialized Training: Employees participate in training programs on encryption, SIEM systems, and compliance requirements. Breach Simulations: Regular exercises simulate data breach scenarios to evaluate response readiness and improve team preparedness. Through these robust procedures, Trunscend shall enhance security and compliance, minimizing risks and protecting user rights in alignment with the highest standards. Can I update or correct my information? The rights you have to request updates or corrections to the information Trunscend collects depend on your relationship with Trunscend. Personnel may update or correct their information as detailed in internal company employment policies, where applicable. Customers have the right to request the restriction of certain uses and disclosures of personally identifiable information as follows. You can contact us in order to (1) update or correct your personally identifiable information, (2) change your preferences with respect to communications and other information you receive from us, or (3) delete the personally identifiable information maintained about you on our systems (subject to the following paragraph), by cancelling your account. Such updates, corrections, changes and deletions will have no effect on other information that we maintain, or information that we have provided to third parties in accordance with the Policy prior to such update, correction, change or deletion. To protect your privacy and security, we may take reasonable steps (such as requesting a unique password) to verify your identity before granting you profile access or making corrections. You are responsible for always maintaining the secrecy of your unique password and account information. You should be aware that it is not technologically possible to remove every record of the information you have provided to us from our system. The need to back up our systems to protect information from inadvertent loss means that a copy of your information may exist in a non-erasable form that will be difficult or impossible for us to locate. Promptly after receiving your request, all personal information stored in databases we actively use, and other readily searchable media will be updated, corrected, changed or deleted, as appropriate, as soon as and to the extent reasonably and technically practicable. If you are an end user and wish to update, delete, or receive any information we have about you, you may do so by contacting the organization of which you are a customer. Sale of Business and Affiliates We reserve the right to transfer information to a third party in the event of a sale, merger or other transfer of all or substantially all the assets, liabilities and goodwill of Trunscend or any of its Corporate Affiliates (as defined herein), or that portion of Trunscend or any of its Corporate Affiliates to which the Service relates, or in the event that we discontinue our business or file a petition or have filed against us a petition in bankruptcy, reorganization or similar proceeding, provided that the third party agrees to adhere to the terms of this Policy. We may disclose information (including personal information) about you to our Corporate Affiliates. For purposes of this Privacy Policy, "Corporate Affiliate" means any person or entity which directly or indirectly controls, is controlled by or is under common control with Trunscend, whether by ownership or otherwise. Any information relating to you that we provide to our Corporate Affiliates will be treated by those Corporate Affiliates in accordance with the terms of this Policy. Governing Law This Privacy Policy is governed by the laws of Greece without regard to its conflict of laws provision. You consent to the exclusive jurisdiction of the courts of Athens in connection with any action or dispute arising between the parties under or in connection with this Policy. The laws of Greece, excluding its conflicts of law rules, shall govern this Agreement and your use of the app. Your use of the app may also be subject to other local, state, national, or international laws. By using Trunscend or contacting us directly, you signify your acceptance of this Policy. If you do not agree to this Policy, you should not engage with our app, or use our services. Continued use of the app, direct engagement with us, or following the posting of changes to this Policy that do not significantly affect the use or disclosure of your personal information will mean that you accept those changes. Your Consent We've updated our Policy to provide you with complete transparency into what is being set when you visit our site and how it's being used. By using our Trunscend, registering an account, or making a purchase, when applicable, you hereby consent to our Policy and agree to its terms. We are not responsible for the content, accuracy or opinions expressed in such websites, and such websites are not investigated, monitored or checked for accuracy or completeness by us. Trunscend does not make any representation as to the accuracy or suitability of any of the information contained in those advertisements or sites and does not accept any responsibility or liability for the conduct or content of those advertisements and sites and the offerings made by the third parties. Advertising, whenever employed, shall keep Trunscend and many of the websites and services you use affordable or free of charge. We work hard to make sure that any ads introduced within the application environment are safe, unobtrusive, and as relevant to the app Services as possible. Third party advertisements and links to other sites where goods or services are advertised are not endorsements or recommendations by Trunscend of the third-party sites, goods or services. Trunscend takes no responsibility for the content of any of the ads, promises made, or the quality/reliability of the products or services offered in all advertisements. Cookies for Advertising These cookies collect information over time about your online activity on the app and other online services to make online advertisements more relevant and effective to you. This is known as interest-based advertising. They also perform functions like preventing the same ad from continuously reappearing and ensuring that ads are properly displayed for advertisers. Without cookies, it’s really hard for an advertiser to reach its audience, or to know how many ads were shown and how many clicks they received. Cookies Trunscend uses "Cookies" to identify the areas of our app that you have visited. A Cookie is a small piece of data stored on your computer or mobile device by your web browser. We use Cookies to enhance the performance and functionality of our app but are non-essential to their use. However, without these cookies, certain functionality like videos may become unavailable or you would be required to enter your login details every time you visit the app as we would not be able to remember that you had logged in previously. Most web browsers can be set to disable the use of Cookies. However, if you disable Cookies, you may not be able to access functionality on our app correctly or at all. We never place Personally Identifiable Information in Cookies. If We become aware that We have collected Personal Data from anyone under the age of 14 without verification of parental consent, we take steps to remove that information from our servers. Google Maps API collects information that is held in accordance with its Privacy Policy] Individual Data Subject's Rights - Data Access, Portability and Deletion At Trunscend, we are committed to protecting personal data and supporting the data rights of our users under the Regulatory Framework. While we are still in the process of developing advanced tools for data management and compliance, we have established foundational practices to safeguard your data and provide transparency. Currently, we process and store personal data using secure systems and aim to work with GDPR-compliant vendors as we expand our operations. Personal data is retained only as long as necessary to fulfill the purposes outlined in this Policy. If your account is deleted, we will dispose of your data securely within 60 days, in accordance with applicable laws and regulations. As our platform grows, we plan to introduce self-service tools that allow you to access, update, retrieve, and delete your data directly through the app. Until then, we are here to assist you. If you need to exercise any data rights (e.g., access or deletion requests), our support team will work with you to fulfill your request promptly and in compliance with the Regulatory Framework. Users can request access to their account data and activity logs processed by Trunscend. Access is provided through a secure identification process to protect privacy and ensure transparency.
